Different year of Birth on ACS filing and EOI

Hi Guys,

I have the following confusion by having 2 different DOB's. My actual year of Birth is 11th March 1980; however, my year of birth in Passport and educational certificates show as 11th March 1979. I dint have my original birth certificate at the time of filing my ACS. Now my scores are 75 for 189 visa, 80 for 190 Visa. Considering less time span that I got in hand for EOI invitation before my age points goes down by 10 ( i.e 15 pts for above 40 years old),which would affetc my overall scores. Please share your inputs as in if following options can help me.

1. Can I update my EOI with 1980 year of birth as per original certificate so that I can have more time in getting considered for EOI rounds.
2. Can Case Officer accept original Birth certificate even though ACS filing has a different year of birth.
3. Should I go for new ACS filing with this Birth Certificate starting from scratch.

Can apply for birth year correction but would be tedious.

You first need to correct your passport, and then align other documents or have a declaration.

Can Case Officer accept original Birth certificate even though ACS filing has a different year of birth.
He most probably will ask for some legal documents of this change.

Thanks for your prompt reply. Do you mean that I need to first update the passport for DOB before filing for EOI and then present the same to case officer for clarification at later stage ? Are there any chances of CO rejecting me citing inconsistent information provided though after seeing the updated passport copy ?

Please clarify.

Firstly, you cannot have different DOBs in your Passport and EOI/visa application. So, if you want to put a different DOB in EOI/visa application, you first need to correct that in your passport, simple as that.

About CO, as you haven't lodged visa application yet, you don't need to provide anything additional about your DOB to your CO. You just upload your latest passport in your visa application. You need to provide all old passport numbers and old names (if any), but you don't need to notify about the change of DOB as long as you have that aligned in all your documents.

Even if you need to upload old passports for some reason, you can always explain it to your CO as long as you change your DOB through official/legal channel.
