Dear All,

I've applied for my PR -189 in last April, at the time of applying I was in Austrlia with 400 visa(business visa). However, I have not applied for any bridging visa at that time as I had plans to comeback to Australia on long term work visa - 482.

I did come back to australia in 482 but now my project is getting over in another one or two months and my employer is trying to send me back to home country.

Unfortunately, current global visa processing timlines shows that it would take upto 18 to 33 month, so, I'm thinking of applying for a briging visa and after that resign and look for a new job

Am I allowed to apply for a bridging visa now?

If yes, which type of bridging visa will allow me to work independently in Australia? also any terms and conditions which I need to be aware of?

BTW is there any better way to deal my situation?

Appreciate if you could advise.

Thank you.
Charlie

BV does not offer you any special privilege itself, it just carries the same privileges that your existing visa covers.

Hi @MysticRiver,

Thanks for the response, let me explain you my situation clearly

Feb 2019- Entered Australia with 400Visa(business)
April-2019- Application lodged for PR -189(Not applied any bridging Visa)
May 2019- Left Australia as my 400visa expired

After that, I went back to my home country and processed long term work visa (482) which is company sponsered and then came back to australia here are my timelines

July-2019- Entered australia with 482visa and continuing with that currently.

However, my employer now asking me to return to home country as the project that I'm working is getting over by this Decemeber.

Therefore, I'm thinking of resigning (which means 482 sponsorship wil be lost) and apply for bridging visa based on PR application and search a new job and continue to work in Australia.

I believe by default bridging visa A will be granted when you apply for PR application within australia and have to apply for bridging visa B if I need to travel outside australia.

However, my agent says now I can not apply for briding visa as I'm on 482 visa, is that true?

Is there anyway I can apply for Bridging visa B?

Are there are any work retstrictions?

I'd be grateful if you could advise.

You should have automatically received a BVA, you didn't need to apply for it.

I am not sure, but I don't think that's true.

You need an existing BVA or BVB to apply for a BVB.

Yes, I have recevied this after submitting PR application but afterthat I was issued with 482. So in that case is my BVA is still valid?

Ok, if anwer is yes to the first question, I shouldn't have any issues to apply for BVB now right?

BTW my BVA conditions mentioned as "no conditions" does it mean I can work ?

That's an interesting question, I am not so sure. If I were you, I would call DHA to clarify this.

Maybe. Usually, BV passes the same privileges as the expiring visa unless mentioned otherwise. But for your case, it's a bit complex due to your subsequent 482, so you should give DHA a call and clarify your confusion.

let us know if you get some info from DHA,
after going through your timelines my opinion is - when you were on 400 visa and applied for 189 visa you were granted a BVA and that would have activated once your 400 expires and you need to be in Australia to have this thing happen, but you left the country before your 400 expired which means your BVA never got activated and since you left the country it nullifies BVA (I guess) and again you applied to 482 and came back to Australia and wants to activated your already expired / never activated BVA which quite interesting to know what DHA recommends.
