Dear MysticRiver,

for subclass 189, I understand that the minimum is Competent English (IELTS band 6) for EOI submission, and for subclass 190 (e.g. Victoria), some jobs requires Proficient English.

But for subclass 189 in general, IELTS band 6 should be sufficient for EOI submission, am I right?

I am asking because a friend is saying that his migration agent is telling him to hit IELTS band 7 as a requirement for his subclass 189 submission

Minimum eligibility criteria in IELTS is 6 in each band. However he has to ensure minimum 60 points as well. So if he already achieved at least 60 points with IELTS 6, he is eligible, otherwise he needs to improve his point (by better IELTS result or other means).

Dear MysticRiver, my husband and myself live in Australia and have a PR (sposored by Victoria). My brother and his girlfriend are planning to apply for PR based on her occupation which is in SOL (261111-ICT business analyst) in 1,5 years when she is 25 and has 3 years work experience after her 4 years Bachelor degree (with Major in ICT) in Russia. As far as I understand, she will be deducted of 2 years of her experience after the uni by ACS which will leave her with 1 year experience and gives 0 points. Can they still apply proveded she makes up for the missing points either by points in English or State sponsorship and have 60 points as a result (30-age; 15-qualification; 0-occupation, but still accepted, rights?; 10-English 7 (or 20 - English 8); 5-Victorian sposorship). Will her occupation be still considered though with 0 points? Thank you for the reply!

Yes, she will still be eligible as long as she can claim 60 points by other means.

There are no issues by having 0 points in any of the items' criteria. She must prove 55p (if sponsored by any state such as Vic or NSW) or 60p (for 189 visa).

Thank you for the answer!:) How do we make sure she is not deducted more than 2 years (which was the case with my husband who was assessed of having Bachelor degree with Major in computing), but ACS deducted 4 out of his 5 years experience stating: the following employment after july 2012 (though his real work experience starts in May 2008) is considered to equate to work at an appropriately skilled level and relevant to 135112 (ict project manager) of the anzsco code. We finally lost 10 points out of 70, not just 5 and didn't get why (we got the visa though). We don't want my brother and his girlfriend to find themselves in the same situation or even worse in their case, as she will only has 3 years of experience. Thank you!

May be he completed his graduation in July 2010? Or, his degree was not considered as ICT major. Or they just made a plain mistake, you could have asked.

There is nothing you can do to "make sure". There is nothing you can change in his/her past education/experience, right? All you can do is to wait for their assessment and then ask ACS if you feel some mistake happens. For official stand of ACS regarding number of years to be deducted (ranges from 2 years upto 8 years), check below post.

He graduated in 2008, right before starting to work. And the ACS document says: Bachelor with Major in ICT. Can it be that he didn't have enough subjects/ or job titles/ first job respobsibilities related to Project management (as he applied for Project Manager in ICT occupation)?


There is nothing you can do to "make sure". There is nothing you can change in his/her past education/experience, right? ACS said:
If your degree is assessed as having an ICT major which is NOT closely related to your nominated occupation, you will require 4 years relevant work experience completed anytime in your past work history to meet the suitability criteria.

Well, I haven't heard any such thing. But theoretically I am not sure what they will do if someone's record requires them to deduct 4 years whereas he/she has 3 years. Nevertheless, you have to see their outcome and then take necessary steps. ACS assessment is not a big deal, you can apply multiple times if you want. Just few days back, one of our member successfully changed his occupation when he requested re-assessment.

Upon thinking a bit, I think you are right that the applicant needs to fulfill the suitability criteria period at least. That means, if they need to deduct 4 years, the applicant should have at least 4 years experience. That said, there is no need to have anything extra than that if she does not plan to claim any points.

Hi MysticRiver, a relative who is a UK medical graduate "fresh from the oven" is interested to apply for subclass 189, just a rough calculation of points:
age: 25
education: 20 (medical graduate is considered phd?)
english: 20 (assuming 8 in all bands)
65 point, did i miss anything?
