Process to extend I.E.D

Hi All,

Does anyone recently requested the Department for extending the I.E.D.?
What is the process and probability in getting it done. We got 3 months to travel , I understand it is not short time but then it is also not so long if one doesn't have Job there.

The case officer himself acknowledge "The Department acknowledges that the initial entry date provided of 07 December 2017 may be short and therefore the Notice to visa holders letter attached to this email applies to your particular circumstance."

However letter is bit ambiguous "
General Skilled Migration; however; has no objection to visa holders travelling to Australia in breach of condition 8504 and will not seek to cancel a visa where the only reason for doing so would be the breach of this condition."

Is it mean if only reason is breaching I.E.D , visa will not be cancelled?

Any insight are appreciated!

As per latest communication from DIBP, IED is not important for PR holders. Details in
https://www.migrationdesk.com/threads/7-things-to-do-first.58/page-2#post-57256
Thanks Mystic, In that thread there is mention of two letters. One that we already received during our Grant notification and that is Notice related to 8904 condition. where as Sachin has requested wavered email from department . so shall we require both or just notice is suffice in travelling after I.E.D expiry.

Better to ask on that thread so that the people who went through that (e.g. @Trapme, @Sachin) can reply from their experience.

See, I didn't take a chance even though, I had both with me. I traveled along with family before IED date.

Hey Rakshanda, thanks for reaching out :) Nothing has changed much. I m back India as went to Sydney for one week and returned. This month I also traveled again to Melbourne along with family for 2 weeks. My plan is to make a move next year. I am waiting for my company to give me opportunities to get there. If they will not then probably, i will resign and go. Its difficult decision to move again without job but I have to take a chance and hopefully it will be positive. How are the things with you? Have u got your IELTS ? Do you have points to get your visa. I will pray to god that you will get your soon. Thanks for your help and will be in touch.

Hi Trapme

I am considering to write an email to the relevant authority to request for a IED extension. This is because I found out I am pregnant and from where i am to Australia take about 30+ hours on the fastest fight. My 189 granted around mid Sep and my IED is end of April of 2018. I knew you had experience writing to them so would you mind letting me know who is the authority that i can write to? (what is their email?)

Many thanks
Zoe

@Trapme can you please answer this if you come around anytime? Thank you.
Many thanks Rakshanda! Also, I am browsing through some old thread on this IED topic and it seems to me IED doesn't matter for 189 PR visa holder, is this correct or just my mis-impression? Although there people who received extension on IED, did they eventually enter the border without issue to your knowledge? there doesn't seem to many people report on that and I knew Trapme didn't take the chance.

Many thanks for everyone's attention and assistant.

Well, its something like we call a grey area. Usually when you are given an IED, you should be entering the country before that date, but many times people want to get it changed due to their personal circumstances. Hence one should abide by the rules. You wouldn't want your grant to be void just because of an IED :)

Hi Zoe, you can write to the email address : [email protected] by mentioning your reasons why can't travel before the IED data, in your case, very valid reason. I am sure, they will extend your IED or they will give you an email which specify that you are allowed to travel after the IED date. Good Luck.

@Zoe, @Trapme , @MysticRiver

I have a very similar Situation here at hand, i & my wife got our Visa Grant on 6th Nov 2017 and the IED is given as 26th Dec 2017. Now the thing is that my wife is 6 Months pregnant with Twins, and she is not is a state medically where she is comfortable to travel immediately even if it is to comply by visiting for a week before the IED.

We had done our EOI on 15th Dec 2016 and PCC verification was done on 27th Dec 2016 and Medical Assessment was done on 24th Dec 2016.

We had hired a consultant who sent a mail to [email protected] on Fri, Nov 10, 2017 providing all the medical documents and doctor certificate showing her unfit to fly. However we have not heard anything back from them until now, and time is running and IED is approaching very fast.

I even tried calling 131 881 contact number mentioned on http://www.border.gov.au however i always 100+ in queue and am unable to connect with them.

Can someone please help me if you got any support on the same, @Zoe can you please help if you have any update in such similar situation, who to approach and get this done immediately as the IED is only a month ahead.

My Visa Grant Letter states the below details and gives no clause as mention in the post about 8504, as a matter a fact i dont even know what is visa condition 8504. If someone can please help me understand:

I think somewhere in one of the thread Mystic mentioned that this is no longer necessarily to travel before IED and you can send email to [email protected] to get the letter which states that you can travel after the IED date and still you are allowed to travel and your visa will not be canceled.

This is what DIBP replied to one of our member's query which suggests IED is not important for PR subclasses. But there is not official thing on the website so far.
https://www.migrationdesk.com/threads/7-things-to-do-first.58/page-2#post-57256
@MysticRiver - only FYI since we were conversing about it. I had written to skilled support for IED waive off and facilitation letter. Today got an email from them with 2 attachments (both facilitation letter).I think this settles the problem.
Letter 1
----------
The grant of your General Skilled Migration visa included the following visa condition:
8504 The holder must enter Australia as the holder of the visa to which the condition applies
before a date specified by the Minister.
This condition requires that an initial entry into Australia by each visa holder be made before the
date specified in the “Visa Grant Notice” provided to you when your visa was granted.
General Skilled Migration is aware that you and/or your family members who were granted a visa
as part of your application may not comply with this condition.
Failure to comply with visa conditions can render a visa liable for cancellation under the Migration
Act 1958 and visa holders are encouraged to make their first entry by the initial entry date.
General Skilled Migration; however; has no objection to visa holders travelling to Australia in
breach of condition 8504 and will not seek to cancel a visa where the only reason for doing so
would be the breach of this condition.
Visa Validity Period
This notice can only be used during the period for which you hold a valid visa. Information about
your visa validity period is also contained in the “Visa Grant Notice”.
If your General Skilled Migration visa has ceased for any reason then you cannot use this notice to
enter Australia as the holder of this visa.

Letter 2
----------
File Reference: aaaaaaaaaaa
ICSE Request ID: bbbbbbbbbb
Primary Visa Holder: XXXXX
Visa: Skilled - Independent (Web)(SI 189)
NOTIFICATION REGARDING TRAVEL IN BREACH OF VISA CONDITION 8504
Dear XXXXX
I am writing with reference to the Class SI subclass 189 visa(s), granted on 04/09/2017,
and which included the following visa condition:
8504 The holder must enter Australia as the holder of the visa to which the
condition applies before a date specified by the Minister.

This condition required that an initial entry into Australia by each visa holder be made
before 21/11/2017.
Recently this department received correspondence advising that the following visa
holder(s) may not comply with this condition by entering Australia within the prescribed
timeframe.
• XXXXXX
• YYYYYY
While failure to comply with visa conditions may render a visa liable for cancellation under
the Migration Act 1958 I am writing to advise that the department has decided not to
cancel the relevant visa(s).
General Skilled Migration has no objection to the visa holder(s) travelling to and entering
Australia while they continue to hold a Class SI Subclass 189 visa.
The expiry date of the visa(s) is: 04/09/2022
If your General Skilled Migration visa has ceased for any reason then you cannot use this
notice to enter Australia as the holder of that visa.
