Guide Submitting visa application: step by step guide (Subclass 189)

Due to the popularity of step by step guide for submitting EOI and members' request, here I am trying to summarize the procedure for submitting your visa application once your EOI gets invitation.

Once you get invitation for your EOI, you need to accept that EOI before proceeding for visa application. Once you accept, you will be presented with a link for visa application. Before you accept anything, keep in mind the below points:
  • You will have 60 days to accept the EOI invitation: You can accept anytime within 60 days. Once you are invited, your invitation will never be revoked within this period, so don't be panicked and rush into next steps, rather take it easy (you have waited so long, so extra few days will not cause any apocalypse).
  • Once you accept, you are bound to prove all your points: So if you have claimed extra points in your EOI, by mistake or whatever, it's still not too late to correct this - just ignore the invitation (the invitation will expire in 60 days). Yes your process will be delayed and you need to wait for another invitation, but that is better than forfeiting visa fees (minimum $3600 for a person, as of today) and possibility of subsequent ban for multiple years.
  • Don't be over-cautions, accept it within 60 days: I heard people who missed the email and failed to meet the deadline. Pretty sure the league of such people is trivial, but just don't join that league !
Okay, once you have accepted the invitation, now you are ready to fill up the long application form. Good news is, like EOI, you can do it in multiple sitting. Below the description of different sections:

Basic Details:
This section is actually mostly self explanatory. Give extra care while filling up the Passport details section. Other names/spellings are if you have changed your name in the past. You need to inform any old name you possessed and the reason of change. You will require to upload the documents as evidence of name change later, in most of the case which include an affidavit and declaration in the form of newspaper advertisement. The first question in Citizenship section ("Is the applicant a citizen of the country of Passport") may seem odd, but there is actually cases where the answer is No. Other passports section asks you whether you have any other current passport (e.g. dual citizenship), this does not ask about any old expired passport. For National identity documents, recommended action is to give both birth certificate and national identity information if possible, where the former is more important.

If you want to include any other person in your application (can be your partner, children or any dependent person), select Yes in Migrating family members question ("Are there any migrating family members included in this application?"). While adding partner/children is pretty straight forward, adding any other dependent will require you to prove their dependence on you (in later stage). You have to pay for them and they will be required to pass health and security clearance (mandatory) as well as minimum English requirements (optional unless you want to pay extra fees). All the members you have added here will be granted a visa at the same time as you'll.

The usual country of residence in Country of residence section is where you are currently living (a short trip/temporary stay does not count). You will be required to update this information if you change your address anytime in future. Authorized recipient is if you nominate someone to handle your visa application on your behalf (e.g. an agent), so the department will communicate with them for any requirements/clarification in any stage of the whole process.

Non-migrating dependent family members is for any dependent member of your family who are not included in your application. You can apply for their immigration as your dependent anytime in future (again, you will be required to provide evidence). However, if you select Yes in this section, you will be required to submit their health examination & PCC with your application no matter you have any plan for them in near future or not.

Intended state of residence is the Australian state you want to move initially. This is no restriction, and there is absolutely no bindings to follow this. Just put whatever you think most appropriate at the time you submit your application. In future, you can just go to any state you want.

Put details of your assessment result in Skills assessment details section. If you claimed points for your partner's skill in your EOI, you need to give information here, otherwise a plain No.

Education:
You need to provide all your educational history from secondary level. Qualification means the class of your degree (e.g. Bachelor Degree in Science, Business or Technology if you have completed your B.Sc in engineering), Course name is your major/certificate name (e.g. Computer Science/HSC/A-Level). For qualifications in secondary level, if you sent your secondary certificates during your assessment, you should choose Qualification = Other qualification or award recognized by assessing authority. The Date from and Date to should match with your certificate, where it is not mentioned, put a good approximation. And Highest recognised qualification obtained is the highest level of Qualification you have put in this section.

Regional Australian study and Credentialled community language sections are self explanatory. For help, visit regional Australia or a low population growth metropolitan area and credential community language pages.

You have to fill this part for all the applicants.

Employment:
All questions are self explanatory, record all jobs you have had in past 10 years. Be brief in Description of duties, no need to write an essay. You must have known by the time that when they ask Overseas Employment, they mean outside Australia, not outside your native country. Don't take stress at this stage because you can later change any information you put here by mistake or misunderstanding the question by emailing to your case officer (one case officer will be assigned to you after you submit your application). Also this information has to be filled up for each applicant included in your application,

Language:
You need to fill up your native language and English test result in this section for all the applicants. If any applicant above 18 years is unable to meet English requirements, you have to pay extra fee for them. You can find the the level for Language ability here.

Others:
You need to list down all the countries (other than the usual country of residence you mentioned in previous step) you and other applicants lived in past. For each country, you need to put the last address you had (so if you lived 3 places in a country, just put the last one). The short trip (e.g. vacations) should not be included.

At last there are some Declarations you must made/agree before you proceed to last stage. In this stage you need to pay the fee and submit the application.

Once you submit your application, you can start uploading the supporting documents (pretty much any thing you can provide to support everything you mentioned above). You can also just wait for your case officer to be assigned (which can take few weeks) and asks for the documentation (he will provide a check list and a deadline to submit). If you feel you need more time, you can always ask for extension of deadline with proper reasoning. Normally they always approve without any hassle.

For health requirements and police clearance, I always recommend to wait until they ask for those. The reason is sometimes the process takes much time and those documents have some validity period. So you might end up doing those again in case they expires by the time you are asked to provide.

So, that's all for now, good luck with your application. This process might change anytime, and because I don't have access to that application form (one can access that only by invitation), it might be outdated for some section. If anybody can find any such section or any new addition, please reply to this thread with updated information, I'll then update this post with proper credit.

Dear MysticRiver,

On my spouse's the English requirement, my wife has an Australian degree which she completed in Malaysia which is way back in 2004

I got the below snippet from border.gov.au, so is the above sufficient? or she still needs to sit for IELTS?

Should be enough .. just reconfirm it from your case officer (once assigned). Anyway you need to provide that anytime before visa grant. So you'll have enogh time to check with your case officer. When you ask the question, ask positively (as if you are confident it is enough, still just checking.

Thanks for the prompt reply, just in case (touch wood) it doesn't work out, my wife still should have ample time to schedule an IELTS right?

Yup, like I said, the partner's IELTS is required at the end. But make sure you submit your wife's education certificate plus the proof that her medium of education was english, at the beginning.

If you get lucky, and they accept your wife's education medium as English, you won't need IELTS.

As you said she has Aus degree (some offshore campus of an Aus university i assume), there is high chance they will accept it.

If they don't, for some reason, your wife can seat for IELTS then.

Actually it was a question on dependents, "Are there any legal impediments to this child's travel?"
I misunderstood the word "impediments" earlier and found out the meaning after that:oops:
So, its a "No"

And by the way, the form won't let me proceed if I didn't enter an employment end date for my current employment, does it matter?

Correct. So a common practice (may be the only one actually) is to put the latest date (e.g. today's date if you submit it today) as end date.

On the education section, I made a mistake in my EOI's degree start year, I input 1 additional year and only noticed it in my Visa application form

not sure how critical this is (I am assuming its not since its still a single degree and I don't have additional points if I complete it faster or slower) because my degree was a 2+2 credit transfer, meaning I did 2 years diploma in my home country and complete the other 2 years in Australia

then I noticed that I have to input all my education from secondary level onwards, so I can jsut amend the start year and add my diploma into the list. Do I need to provide results of my secondary education? I only sent diploma and degree for ACS assessment

I'm claiming points for the Regional Australian Study, although I completed the last 2 years of my degree in Australia, the total duration is 2 months short of 2 years because normally the semester starts in Feb and graduation is in Dec.

But I did stay back after graduation and picked cherries until the following Feb but I am unsure how to prove that? I have superannuation for that casual employment but I can't remember what's my TFN anymore.

I recommend to include secondary details because they asked it in the form. This is not very important though and shouldn't matter if you didn't send to ACS.

2) The condition is at least 16 calendar months and 2 academic years. Calendar months and academic years are different things. From what you are saying, I guess you are talking about calendar months, not academic year.

Timeline missing
I have had a search but have not been able to find the answer to this this question, so it would be awesome if someone could give me some advice.

I have submitted my EOI and received my invitation and have NOT claimed points for work experience, I just listed my jobs but then didn't tick the box to say it was related to my nominated occupation (even though they actually are).

Now that I am filling in the main application for my 190 VISA, my work history has been carried over from my EOI, and still there is a box next to each job ticked as not related.

But underneath this there is a now a new question:

Has the applicant been employed overseas in their nominated occupation or a closely related occupation at a skilled level immediately before lodging this application?

Has the applicant been employed in Australia in their nominated occupation or a closely related occupation at a skilled level immediately before lodging this application?

So I am confused by this.

I am worried if I say YES they may think I am trying to add on another 5 points which might complicate things needlessly.

Thanks in advance if anyone remembers answering that question and can help.

First of all, you can't gain any extra points once invitation is sent, even if you want. As soon as invitation is sent, the EOI becomes locked and you can't add/remove any points from your EOI. So, nobody will think you are trying "to add another 5 points", because that is just impossible and unnecessary (even if it was possible, what would you do with extra points, now that you already received invitation? Points are used only for sending invitation, period, no other advantage you will get for having higher points).

Also you don't get any point for being employed in any related occupation at a skilled level immediately before lodging this application, you need minimum 3 years for claiming 5 points. However this point has no meaning now, as I said, your EOI is locked now, and no change in your total point claim will change in this invitation.

Secondly, if you did not claim any point for experience in your EOI, it does not matter if you were eligible for points or not. Nobody will charge you for claiming less point. If you claim extra point, that is a big problem, not the other way around.

As a matter of fact, you have to submit your full employment history (relevant/non-relevant) of last 10 years (for some people they can ask for 30 years) in your Form 80. So, you have to mention these experience in any case.

So, I see no problem putting Yes to those question. Rest assured, your point will no changed from what you claimed in your EOI.

Thanks MysticRiver for the prompt response. Just a follow-up question. Based on my employment history I have 4 years of relevant experience overseas as a nurse (which I did not claim in the EOI) and it is ticked as not related on the visa application since it was carried over by the system from the EOI. Should I make it relevant now? and answer YES to

"Has the applicant been employed overseas in their nominated occupation or a closely related occupation at a skilled level immediately before lodging this application?"
