Dear All,

I was granted 489 visa last week. Visa conditions: 8539 - Must stay in specified area (RDA Southern Inland NSW).

I am currently planning to arrive in Australia in mid June 2018. As I have no relatives or close friends who reside in RDA Southern Inland, I am thinking of arriving in Sydney and officially report to the RDA Southern Inland Office in Goulburn which is about 200kms away from Sydney. According to the current situation, I cannot afford room rental until I find a satisfactory job in Australia. I've heard that it's bit difficult to find a job soon after arriving in Australia as a new comer and it usually takes time to find a job especially in regional areas. But I have several close ones in Sydney who are willing to help me and provide me with accommodation for a few months.

In this context,

1. Would I be able to report to RDA Southern Inland Office and comeback to Sydney and stay there for a few months until I find a job in RDA Southern Inland?
2. Would I be allowed to work in Sydney according to the given visa condition?
3. If not, what are the best alternatives for finding solutions for my current problems?
4. If I didn't find a job related to IT field in the nominated region , would I be able to request to move to any other area where IT jobs are available?

Look forward to your kind clarifications and suggestions.

Best regards,
Anjana

1. You need to clear it with the RDA SI asking for an exemption on a special condition.
2. http://guides.dss.gov.au/guide-social-security-law/9/3/5/380
AUS said:
9.3.5.380 Visa Condition 8539
While the holder is in Australia, the holder must live, study and work only in an area specified by the Minister in an instrument in writing for item 6A1001 Schedule 6A or item 6D101 Schedule 6D of the Migration Regulations 1994, as in force:
(a) when the visa was granted; or
(b) if the holder has held more than 1 visa that is subject to this condition-when the first of those visas was granted.
3. There is no shortcut to this. You have to keep searching, maybe start with some other job at the beginning.
4. Again, depends on RDA SI.

Dear Administrator,

This is what the grant letter says;

Visa conditions
8539 - Must stay in specified area
An explanation of each condition of this Skilled - Regional Sponsored (subclass 489) visa is
provided below.
You can check these conditions at any time by using the Visa Entitlement Verification Online
(VEVO) service. The four-digit number presented next to each condition above is used in
VEVO to identify each condition that applies to this Skilled - Regional Sponsored (subclass

489) visa.

And this is what my visa condition says;

8539 - While the visa holder is in Australia they cannot live, study or work outside of a regional or low growth metropolitan area. This means
anywhere in Australia except in:
• Sydney, Newcastle, Wollongong and the Central Coast in New South Wales
• Brisbane and the Gold Coast in Queensland
• Perth and surrounding areas in Western Australia
• Melbourne in Victoria
• the Australian Capital Territory.

I obtained (this document) these details by submitting my visa grant number to Visa Entitlement Verification Online (VEVO).

In this context, please let me know, according to the above condition; would I be able to live and work in South Australia or any non-metropolitan area in Victoria?

(However, please also note that RDA Southern Inland set me a condition while giving me the sponsorship, that I should report them within 03 months form the date visa granted.)

Look forward to your kind clarifications.

Best regards,

I guess RDA SI imposed criteria gets precedence.

Consider before posting:
  • Do not post the same thing in multiple places.
  • No personal contact and/or non-English phrase is allowed.
  • Always post in a relevant thread or open a new one.
  • Better to use the reactions in a post to congratulate/thank.
